Is THCA Legal Federally?

As of now, THCA is not classified as a controlled substance under federal law, thanks to the 2018 Farm Bill. This legislation made hemp-derived cannabinoids legal—as long as the final product contains less than 0.3% Δ9-THC on a dry weight basis.

Because THCA is not Δ9-THC in its raw form, many interpret this to mean that hemp-derived THCA products are federally legal—but that can change depending on how the product is marketed or consumed.


The Catch: State Laws Vary

While federal law sets the groundwork, state laws ultimately decide legality. Some states have adopted stricter regulations banning or restricting products high in THCA, particularly if they’re seen as a legal workaround for THC-rich cannabis.

Some states consider “potential THC content”—meaning if a product can convert to over 0.3% THC when heated (like smoking THCA flower), it may be treated the same as high-THC cannabis.

  • Arkansas

  • Hawaii

  • Minnesota

  • Oregon

  • Rhode Island (And others may follow. Always check local laws before purchasing.)
